Introduction

1. The following General Terms and Conditions (hereinafter referred to as the "GTC") govern the relationship between Diamedia GmbH and its customers (hereinafter referred to as the "Customer"). The following GTC apply to all deliveries and services listed on the website www.GreenClubCard.ch ("GreenClubCard" or "Site").

Any order placed on this Site confirms that the buyer has accepted the GCS and therefore acknowledges being fully informed of the fact that his agreement concerning the content of these GCS does not require the handwritten signature of this document. The buyer has the option of saving or printing these general terms and conditions, it being specified that both saving and printing this document is his sole responsibility.

2. The GreenClub card enables its holders to benefit from discounts for the acquisition of various services and products from the Partners (the "Merchants") present on the Site.

Delivery territory

Delivery is possible in Switzerland and worldwide.

Delivery time

Deliveries are made within 5 working days.

Shipping costs will be offered.

Prices

Prices are in Swiss francs (CHF) and include the legal VAT.

Terms of payment

Deliveries are made against payment by credit card (MasterCard, VisaCard, PosteFinance).

Complaints

Any complaint related to a defect or an incomplete or incorrect delivery must be communicated to us by e-mail, at the latest within 5 days following the delivery date. After this period, the complaints will not be accepted and Diamedia Sàrl will be released from any responsibility.

Liability and Warranty for Services

Diamedia GmbH 's liability for the services offered is limited to publishing the offers and the associated conditions as agreed with the Merchants on its website GreenClubCard.ch so that the cardholder can refer to them at any time.

The GreenClub card, managed and owned by Diamedia Sàrl, is only a medium linking the Merchant with the cardholders and thus enabling them to conclude commercial transactions, namely the sale/purchase of the services linked to it and published on the Site. The Merchant understands and accepts that Diamedia Sàrl acts as a transparent intermediary, i.e. as a direct representative of the Merchant, and therefore bears no responsibility for the proper execution of the services offered.

On the other hand, the Merchant commits himself:

  1. to recognise the advantage cards issued by Diamedia Sàrl,
  2. to comply with the relevant conditions,
  3. to provide the services and/or benefits as indicated on this contract and presented on the Website.

Furthermore, since the image of Diamedia Sàrl is associated with the quality of the service, the Merchant undertakes to provide the service and to treat the customers holding the GreenClub card with diligence.

Damages

Claims for damages due to errors in illustrations, prices or texts or due to late or missing delivery are completely excluded.

Data protection

The data necessary for the execution of orders are of course treated in strict confidence.

Security and privacy

Diamedia Sàrl has an obligation to protect your privacy. We use the information we collect about you to process orders. We will NOT sell or rent your personal information to third parties, nor will we trade it with third parties.

Registered user

If you register as a registered user and subscribe to our newsletters, Diamedia Ltd. reserves the right to send you its newsletter. However, you can unsubscribe from this newsletter service at any time. You will find a link to unsubscribe in each newsletter.

Required data

In order to be able to execute an order correctly, we need your first name, surname, e-mail address, telephone number, mail/delivery address and credit card number as well as the expiry date and security code of this card.

Securing customer information

When you place an order with us and thus give access to your account information, we use a security certificate (data encryption) to ensure the protection of this data. The security certificate (SSL) encrypts all information you enter before it is transmitted to us. In addition, all customer data is protected against unauthorized access.

The present general conditions are for the moment only written in French.

Legal forum

Any dispute arising in connection with the operation of the GreenClub card will be governed by the above general terms and conditions of sale. If, despite everything, the dispute should nevertheless persist, a so-called "amicable" solution will be preferred.

All obligations are subject to Swiss law. The place of performance and place of jurisdiction is Blonay.
